Man Files Case Against His Own Wife For Not Being Female
A man has filed a case against his own wife calling her “not female”, what is the full story?
A man from Madhya Pradesh has filed a case against his own wife claiming that She is not a Female. The man's statement says the couple was married in 2016 but his wife "did not consummate their marriage for some days saying that she was on her periods". Saying this she left her Husbands house and returned after six days. He says later when he tried to have sex with his wife, he found "no presence of a vaginal opening and found she had a small penis, like a child". The man later took his wife for a medical check-up and the results were that she has a medical problem called "imperforate hymen & congenital adrenal hyperplasia". So she is not a female according to the medical testing. In order to understand this medical condition of Imperforate hymen, you’ll have to first understand what “Hymen” is. So Hymen is a layer that partially covers the women’s vagina, which later breaks after the woman has sexual intercourse or it can even be torn while doing intense exercise post that the woman can have natural sex. Now coming back to the condition of imperforate hymen, it is a medical condition where the hymen fully covers the front part of the vaginal opening which results in the vaginal opening being blocked.
Congenital adrenal hyperplasia is a medical condition where a female clitoris is enlarged & the private part of the woman looks like the private part of a male child. The man says his wife was earlier advised by a doctor to get her condition surgically corrected but the doctor said the chances of pregnancy were close to impossible even after the surgery is done. The man felt cheated and called his father-in-law, asking him to take his daughter back. According to the man, the woman had surgery and then returned to her husband after her father forcefully entered his house and threatened the man to keep her. The man later filed a complaint with the police and approached the court seeking a divorce. However, the Gwalior bench of the Madhya Pradesh High Court had dismissed the man's petition saying that the court can’t believe anything just because someone is saying it, in order to prove it the court requires evidence that was not present in this case.
That time the man had made a verbal complaint. He did not present the medical reports. The man decided to challenge the High Court’s decision by again filing his petition to the supreme court along with the medical history of his wife. Replying to the questions asked by the court the man’s lawyer Senior Advocate N.K Mody said that this is not a case of some medical disorder, this is purely a case of cheating where his client was not told about this condition and was cheated to get married to a male. Looking at all the evidence, Justices Sanjay Kishan Kaul and MM Sundresh on Friday asked the woman to file a reply to her husband's petition challenging the Madhya Pradesh High Court’s order.
