You may think that an AI-generated selfie with a Bollywood star will not get you into trouble. But yes, it can!
In recent weeks, top Bollywood stars like Aishwarya Rai Bachchan, Abhishek Bachchan, and Karan Johar have gone to court to protect their personality rights. These rights mean a person can control and benefit from their identity such as their name, photo, voice, style, or even a catchphrase. They also stop others from exploiting a celebrity’s fame for profit without consent.
India does not yet have a specific law for personality rights. Courts rely on common law, while places like California have clear written protections. This gap often leads to misuse, where small businesses or individuals use celebrity images to promote products.
Recently, the Delhi High Court gave strong directions against the unauthorised use of Aishwarya Rai Bachchan’s identity. Justice Tejas Karia said that using a celebrity’s image without permission not only causes financial loss but also violates their privacy and dignity. This case came after AI-generated pornographic images and fake products using her face were shared online. The court ordered a ban on unauthorised digital content, including deepfakes and face morphing.
Abhishek Bachchan also approached the court to protect his likeness from misuse, while filmmaker Karan Johar recently received relief in his own case. Earlier, actors Anil Kapoor and Jackie Shroff also took legal steps to safeguard their images and catchphrases.
This shows that Bollywood celebrities are now standing firm against unauthorised exploitation of their identities.
